Terms of use Dualcoin

1. General Provisions

This agreement (hereinafter referred to as the Agreement) describes the rules and conditions under which the cryptocurrency exchange services of DUALCOIN are provided. It is an official written public offer addressed to individuals (hereinafter the User) to conclude an Agreement on the provision of services by the DUALCOIN service on the terms set forth below. Before using the services of the DUALCOIN service, the User must fully familiarize themselves with the terms of this Agreement. The use of DUALCOIN services services is only possible if the User accepts all the terms of the Agreement. The current version of the Agreement is publicly available on the DUALCOIN service website (https://dualcoin.io).









2. Terms and Definitions

DUALCOIN Service is the name for cryptocurrency exchange and offers its services through a special software interface for all Users.

The Services website - https://dualcoin.io.

User - any individual who wishes to use the services of the DUALCOIN service and has accepted the Agreement in accordance with its terms.

Payment/Transaction - the transfer of cryptocurrency from the payer to the recipient.

Order - information submitted by the User, using the Services means, in electronic form, indicating their intentions to use the Services services on the terms offered by the Service and specified in the order parameters.

Source Cryptocurrency - the cryptocurrency that the User wishes to exchange.

Source Account - the wallet number or any other designation of the Users account from which the Source Cryptocurrency was sent.

Receiving Cryptocurrency - the cryptocurrency that the User receives as a result of exchanging the Source Cryptocurrency.

Receiving Account - the wallet number or any other designation of the Users account to which the receiving cryptocurrency will be sent.

Cryptocurrency Reserve - the amount of a specific cryptocurrency available to the DUALCOIN Service at the time of creating the Order.

Cryptocurrency Exchange - the exchange of one cryptocurrency for another cryptocurrency.

Exchange Rate - the value ratio of two electronic cryptocurrencies during their exchange.

Service Disruption - interference with the software or hardware part of the Service; distortion of parameters transmitted to the Service; as well as the creation of orders without their actual payment for a certain system time interval.


3. The Subject of the Agreement

3.1. The subject of this agreement is the provision of cryptocurrency exchange services through the Service between individuals.

3.2. The Service offers its services to all Users and does not supervise User transactions in any other systems.

3.3. Any completed cryptocurrency exchange transaction cannot be canceled by the User after its completion, i.e., after the User has received the cryptocurrency due to them under the previously accepted transaction conditions.

4.1. Rights and Responsibilities of the Service

4.1.1. The Service provides its services on an "as is" basis as described on the pages of the Services website and does not offer any additional warranties.

4.1.2. Concerned with the quality of services provided to Users, DUALCOIN Service undertakes to perform all actions within the framework of this Agreement.

4.1.3. The Service guarantees the fulfillment of obligations to the User only within the limits of the amount entrusted to the Service by the User for the exchange operation.

4.1.4. The Service will make every effort, but does not guarantee that its services will be available 24/7. The Service is not responsible for the losses, lost profits, and other costs incurred by the User due to the inability to access the website and services of the Service.

4.1.5. The Service is not responsible for the losses, lost profits, and other costs incurred by the User as a result of delays, errors, or failures of third-party systems/exchanges. It is also not responsible for the Users lost profits and other costs resulting from the Users mistaken expectations regarding the Services tariff rates, transaction profitability, and other subjective factors.

4.1.6. In order to counteract the legalization of criminally obtained income and the financing of terrorism, DUALCOIN service has the right to act in accordance with the Service Policy.

4.1.7. The Service may suspend or cancel a transaction in progress if the User violates the terms of this agreement and return the funds deposited by the User to the users details.

4.1.8. The Service has the right to restrict the Users access to the Services services if the User violates this agreement or if there is suspicion of the User attempting to disrupt the Services operation (see Terms).

4.1.9. The Service, using a technically complex software product, allows for the possibility of a technical failure and reserves the right in such cases to refuse the user to fulfill the terms of the contract, with a subsequent refund to the users details in full.

4.1.10. The Service has the right, in case the User transfers funds to the Service in an amount different from that specified in the order, to consider this as the Users instruction to recalculate and automatically execute the order according to the actually received amount, without additional agreement with the User.

4.1.11. The Service has the right to unilaterally terminate the agreement with the user and refund the funds if the payment from the user is received within a period exceeding the time allotted for the order payment.

4.1.12. The Service has the right to impose the costs associated with the return of the received funds on the User in cases specified in paragraphs (4.1.4, 4.1.6, 4.1.7, 4.1.10, 4.1.11).

4.1.13. In case of the need to refund funds to the users details, the Service will make every effort, but does not guarantee the immediate receipt of the refunded funds by the user. Funds will be returned within one day, and in some cases, up to 7 banking days.

4.1.14. The Service has the right to request additional information from the user within the framework of the exchange. If the user refuses to provide the requested data, a refund will be made (at the discretion of the Service - the refund may be made to the source of funds).

4.1.15. The Service has the right to refund funds to the source of funds if the user does not specify other details for the refund of received funds. Any instructions from the User to the Service are accepted only by sending a letter directly from the Users email address specified in the application to the Services email. In case of impossibility or refusal (as well as ignoring) of the Services request to clarify the details by the above method, the Service reserves the right to return the received funds to the source of funds.

4.1.16. Conditions for fixing the exchange rate. The Service fixes the rate only after the required number of confirmations is reached. Each cryptocurrency has its own required number of confirmations.



4.2. Rights and Responsibilities of the User

4.2.1. The User must consider that the only acceptable way for the service to change details in a created order is an email sent from the Users email address specified in the order.

4.2.2. The User undertakes to independently calculate and pay all taxes required according to the tax legislation of the Users location.

4.2.3. By transferring funds for exchange to the details provided by the Service in the order, the User confirms their agreement with this Agreement.

4.2.4. The User may express gratitude for the Services work in any convenient form.

4.2.5. The User undertakes not to use the Service for fraudulent and illegal transactions and not to provide knowingly false information.

4.2.6. The User undertakes not to disrupt the operation of the Service.

4.2.7. The User has the right to request a refund before the actual completion of the exchange by the Service. By giving such an instruction, the User agrees that the Service does not reimburse the Users expenses related to the payment of the order (fees, transaction sending costs, and others). The User also agrees to reimburse the Services costs associated with the refund, which will be automatically deducted from the refunded funds.

4.2.8. Terms of creating an exchange order. By using the services of the DUALCOIN Service, the User confirms that: - selected the cryptocurrencies they plan to exchange;
- entered an address to receive the cryptocurrency, read and confirmed the Services documents;
- sent the cryptocurrency to the specified address within the specified time. After this time, the funds are released from reserve and returned. The User is warned that reusing this address is prohibited;
- the Service exchanges cryptocurrency through liquidity providers and delivers them to the address specified by the User. The User is warned that the exchange rate may change due to cryptocurrency market volatility. The floating rate is recalculated only in case of a decrease in the cryptocurrency price;
- the exchange process takes 15-30 minutes, but delays may occur due to liquidity providers or network congestion.

4.2.9. The User has the right to obtain additional information within the framework of the created exchange through email, a call to the Services support phone, or in the online user support chat."


5. Guarantees and Responsibilities of the Parties

5.1. DUALCOIN Service is not responsible for User losses incurred as a result of the unlawful actions of third parties.

5.2. The Service guarantees the fulfillment of the terms of this agreement.

5.3. The User is obliged to provide accurate information when filling out the Order. If the User has not specified or incorrectly specified the data, DUALCOIN Service is not responsible for the Users losses incurred as a result of the error.

6. Force Majeure

6.1. Neither the User nor the Service shall be liable to each other for delays or failure to fulfill their obligations resulting from force majeure events, including natural disasters, fires, floods, terrorist acts, changes in government, civil unrest, as well as the non-functioning of exchanges, power systems, communication networks, and Internet service providers.

6.2. In the case of a completed order, the Service is not responsible and does not compensate for losses if the User incorrectly provided details when placing the order. In this case, the Service is not obligated to take actions to return such funds.

In the event that the User mistakenly transfers funds to details different from those provided by the Service for the order payment, the Service is not responsible and does not compensate for losses, nor is it obligated to take actions to return such funds.
